By accessing and using Cashbook Digital ("the Service"), operated by Cashbook Digital ("we," "us," or "our"), you accept and agree to be bound by the terms and conditions of this Agreement. If you disagree with any part of the terms, you may not access the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

For the purposes of these Terms and Conditions:

- "Account" means a unique account created for You to access our Service.
3. Account Registration and Security
3.1 Registration Requirements
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
3.2 Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3.3 User Responsibilities
You may not use as a username the name of another person or entity that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity, or a name that is otherwise offensive, vulgar, or obscene.
4. Subscriptions and Payments
4.1 Subscription Plans
Cashbook Digital offers various subscription plans, including Free, Professional, and Enterprise tiers. The Free plan is limited to single business and single cashbook management. Detailed features and limitations for each plan are described on our pricing page.
4.2 Payment Terms
By subscribing to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as otherwise stated in our Refund Policy. We use third-party payment processors and may update payment methods at our discretion.
4.3 Automatic Renewal
Subscription plans automatically renew at the end of each billing cycle unless canceled before the renewal date. You may cancel your subscription at any time through your account settings.
4.4 Price Changes
We reserve the right to change subscription fees. We will provide you with reasonable notice of any fee changes. Continued use of the Service after fee changes constitutes acceptance of the new fees.
5. User Content and Data
5.1 Ownership of Data
You retain all rights to your financial data, transaction records, contact information, and any other content you upload or create within the Service ("User Content").
5.2 License Grant
By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service.
5.3 Data Portability
You may export your data in Excel and PDF formats as provided by the Service's export functionality. Upon termination of your account, you are responsible for exporting your data before account deletion.
5.4 Data Retention
We will retain your User Content for as long as your account is active or as needed to provide you services. We may retain and use your information as necessary to comply with our legal obligations.
6. Acceptable Use Policy
You agree not to use the Service:
- For any unlawful purpose or to solicit others to perform or participate in any unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service
- To collect or track the personal information of others
- To spam, phish, pharm, pretext, spider, crawl, or scrape
- For any obscene or immoral purpose
- To interfere with or circumvent the security features of the Service
We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Cashbook Digital and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Cashbook Digital.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings.
9. Disclaimers
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Cashbook Digital does not provide financial, legal, or tax advice. The Service is designed to help you manage your financial records but should not be relied upon as a substitute for professional advice.
10. Limitation of Liability
In no event shall Cashbook Digital, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
11. Indemnification
You agree to defend, indemnify, and hold harmless Cashbook Digital and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
- Your use and access of the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right
- Any claim that your User Content caused damage to a third party
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
